Humanitarian and Compassionate Considerations

Humanitarian and Compassionate (H&C) considerations provide an exceptional opportunity for individuals.

About Humanitarian and Compassionate Considerations

Humanitarian and Compassionate (H&C) considerations provide an exceptional opportunity for individuals to request permanent residence when their personal circumstances may justify an exemption from certain Canadian immigration requirements. These applications can involve factors such as establishment in Canada, family and community ties, the best interests of children, and difficulties the applicant may face if required to leave Canada.

Unlike applications under standard immigration programs, H&C requests involve a discretionary assessment of the individual circumstances of each case. The application must explain why the requested exemptions are justified and provide supporting evidence that demonstrates the significance of the humanitarian and compassionate factors involved.

Immigration Vector assists applicants in evaluating their circumstances, organizing supporting evidence, and preparing detailed submissions that accurately reflect their personal histories, connections to Canada, and the potential consequences of an unfavourable immigration decision.

How We Work on Your H&C Application

A humanitarian and compassionate application requires more than completing immigration forms. It involves examining the applicant's circumstances as a whole and presenting the relevant factors through a clear, well-organized, and evidence-supported submission.

Service advantages

01

Establishment and Community Ties

We review your length of residence in Canada, employment, education, community involvement, volunteer activities, family relationships, and other connections to help document how you have established your life in Canada. Where appropriate, we also explain about letters of support and other evidence demonstrating the significance of these relationships and contributions.

02

Hardship and Personal Circumstances

We examine the difficulties you and your family may experience if the requested exemptions are not granted. Depending on your circumstances, this may include family separation, health considerations, limited access to essential services, socioeconomic conditions, and other relevant factors in Canada or your country of origin.

03

Best Interests of Children Assessment

Where children may be directly affected by the immigration decision, we examine how the outcome could influence their well-being, education, family relationships, health, and development. We help organize supporting evidence that explains the potential impact on each child based on their individual circumstances.

04

Application Preparation and Supporting Evidence

We assist with immigration forms, personal statements, statutory declarations, letters of support, employment and educational records, and other relevant documents. Where the case involves complex personal histories, previous immigration refusals, or circumstances requiring additional clarification, we help prepare detailed explanations supported by available evidence.

Additional service information

A humanitarian and compassionate application should present more than a collection of individual circumstances. It should explain how the relevant factors connect, why they are significant, and how they support the requested consideration.

We work with clients to organize their information into a consistent application that presents the circumstances of the case clearly and accurately.

Managing IRCC Requests and Case Progression

After submission, IRCC may request updated documents, medical examinations, additional information, or clarification regarding specific aspects of the application. We review these requests with you, explain what information is being requested, and assist in preparing an accurate response within the applicable deadlines.

Because humanitarian and compassionate applications may involve extended processing periods, changes in personal circumstances can also become relevant. Employment, family composition, health, or other developments may require updated information or additional supporting evidence.

For applicants residing in Canada during processing, we also review immigration status, applicable conditions, and any additional applications or obligations that may require attention. An H&C application does not automatically provide temporary resident status or authorization to work, and applicants subject to removal proceedings may require separate assessment of their circumstances.

Immigration Vector helps clients understand the procedural requirements of their applications and respond to relevant developments as their cases progress.

Our goal is to help you present a comprehensive application that accurately reflects your personal circumstances, explains the humanitarian and compassionate factors involved, and provides the supporting evidence necessary for a thorough review by IRCC.
